CR Rate Enhancement: OMH Emergency Adoption/Proposed Rule Making

Hi everyone – As you all know, one of ACL’s main areas of advocacy is around rate increases for all levels of OMH housing, including CRs and Supported Housing.  OMH and the MRT have heard us.   OMH worked very hard to get us some of the federal Balancing Incentive Program (BIP) dollars and was successful.  The MRT has heard us and will add $5,000 to SH beds when those clients come directly from institutions.  That said, ACL’s advocacy continues for across-the-board, permanent increases for all the programs that will ensure a way to sustain the system.

The following links are the regulations that will govern the Medicaid rate enhancements for rehabilitation services in residential settings through BIP ~ 593.text.10.7.14.  They will provide a 30% rate increase for two years for clients in CRs admitted directly from state psychiatric centers and nursing homes and a 15% rate increase for three years for those admitted directly into Treatment Apartments from state psychiatric centers and nursing homes. The client rosters will go back to April 1, 2014. 

OMH has filed with the Department of State a Notice of Emergency Adoption/Proposed Rule Making to amend 14 NYCRR Part 593 – Medical Assistance Payments for Community Rehabilitation Services within Residential Programs for Adults, Children and Adolescents.  This emergency adoption is effective as of October 7, 2014, and will remain in effect for 90 days. The proposed rule will be published in the State Register on October 22, 2014, and the 45-day public comment period will commence at that time.
