NYS JUSTICE CENTER UPDATE 2-19-15

Dear Colleague,

In September 2014, Governor Cuomo signed S.7232-A (Carlucci) /A.9605-A (Gunther) into law as Chapter 394 of the Laws of 2014. Chapter 394 requires the NYS Justice Center for the Protection of People with Special Needs (Justice Center) to develop protocols to ensure the safety of service recipients during interviews for abuse and neglect investigations. As required by the law, these protocols were developed in consultation with the Justice Center’s statutorily created Advisory Council and the relevant State Oversight Agencies.

The protocols and procedures apply to all investigations of abuse and neglect conducted by the Justice Center, State Oversight Agencies and the facilities and programs defined in section 488(4) of the Social Services Law when acting as the delegate investigatory entity. Please find the aforementioned protocols and procedures attached.

The Justice Center is available to work with State Oversight Agencies and service providers to answer questions about these protocols and to provide training and/or guidance documents as appropriate.
