Hi everyone – There seems to be some ongoing confusion about whether or not people living in non-approved settings are eligible to receive HCBS. They are not. It has come to my attention that some think that they are eligible and can receive the services as long as the services are not provided IN the non-approved setting. That is not the case. They are not eligible at all. Here is the quote from OMH that I received today.
“If the setting is determined to not be a community setting as defined by CMS guidance then the person living there is not eligible to receive HCBS services at all.”
Here is the current status of all the settings. The ones under review may change but I would not count on that. We do not know yet.
