OMH Rule Adoption- Telepsychiatry Services

This comes to us from OMH – of course this does not apply to licensed residential programs but many of you operate other programs so I thought this might be of interest.

OMH has adopted as final a rulemaking that creates a new 14 NYCRR Part 596, Telepsychiatry Services, and repeals Section 599.17 of Title 14 NYCRR. The amendments establish the basic standards and parameters to approve the use of telepsychiatry in certain OMH-licensed programs that choose to offer this service. Currently, existing regulations allow for the use of telepsychiatry by OMH-licensed clinics only. The adopted rule expands this ability to all providers licensed under Article 31 of the Mental Hygiene Law (with the exception of PROS and ACT providers). The adoption also repeals the telepsychiatry provisions currently in existence in Section 599.17, as those provisions will be unnecessary when this adoption is final.

The Notice of Adoption will be published in issue 35 of the State Register on August 31, 2016.
