New OMH Clinic Rules

OMH has published two rules in today’s edition of the State Register. 

ACL does not plan on commenting on these rules, however, those of you that operate clinics should look at them and comment if you feel the need.

The first is a Notice of Adoption that adopts as final amendments to 14 NYCRR Part 588 (Medical Assistance Payment for Outpatient Programs) and repeals 14 NYCRR Part 592 (COPS).  The rule increases Medicaid fees paid to OMH-licensed day treatment programs for children, and repeals a Part that is no longer necessary as the Centers for Medicare and Medicaid Services mandated that COPS funding cease. The increase in Medicaid fees will be effective as of October 1, 2013, when COPS funding ceased. This rule has been in effect via Emergency Adoption since July 15, 2014, and has now been adopted as final.

The second is a Notice of Proposed Rule Making to amend 14 NYCRR Part 599 (Clinic Treatment Programs).  This consensus rule adjusts billing units associated with reimbursement of clinic services to allow flexibility in the delivery of complex care management.  OMH will accept public comments on this rule through c.o.b. November 24, 2014.
